These Terms of Service ("Terms") govern your access to and use of niboo.mt (the "Site") and the childcare directory and enquiry services provided by Niboo ("Niboo", "we", "us" or "our"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. What Niboo is
Niboo is an online directory that helps parents and guardians in Malta and Gozo discover licensed childcare providers and send enquiries to them. Niboo is a listing and introduction service only. We are not a childcare provider, and we do not operate, own, supervise, employ or control any of the settings listed.
2. No advice; independent providers
Information on the Site is provided for general information only and is not professional, legal or childcare advice. Any contract or arrangement for childcare is made directly between you and the provider. You are responsible for carrying out your own checks — including visiting the setting, verifying its licence and suitability, and reviewing its own terms — before enrolling your child.
3. Accuracy of listings
We aim to keep listings accurate and to feature licensed providers, but we cannot guarantee that all information (including fees, availability, opening hours, facilities, ratings or licence status) is complete, current or error-free. Details are supplied by providers or compiled from available sources and may change. Always confirm details directly with the provider.
4. Enquiries and bookings
When you submit a viewing request, call request or message, you authorise us to pass your details to the relevant provider so they can respond. We do not guarantee that a provider will reply, offer a place, or that any particular date, time or price will be available. A "viewing" or "call" request is a request only — it is not a confirmed booking or enrolment.
5. Acceptable use
You agree not to:
- submit false, misleading or fraudulent information, or another person's details without authority;
- use the Site or enquiry forms to send spam, marketing or abusive content;
- attempt to disrupt, scrape at scale, reverse-engineer, or gain unauthorised access to the Site;
- use the Site for any unlawful purpose or in breach of these Terms.
6. Provider listings
Childcare providers may request a listing via the Site. By requesting a listing, you confirm you are authorised to represent the setting and that the information you provide is accurate and that the setting is appropriately licensed. We may add, edit, decline or remove any listing at our discretion.
7. Intellectual property
The Site, including its design, branding, text and layout, is owned by Niboo or its licensors and is protected by intellectual-property laws. You may not copy, reproduce or redistribute it without our permission. Content and images submitted by providers remain their property; by submitting them, providers grant us a licence to display them on the Site.
8. Third-party links and services
The Site may link to third-party websites or embed third-party content (such as maps). We are not responsible for the content, policies or practices of those third parties.
9. Disclaimers
The Site and Services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including as to accuracy, availability, or fitness for a particular purpose, to the fullest extent permitted by law.
10. Limitation of liability
To the fullest extent permitted by law, Niboo will not be liable for any indirect, incidental or consequential loss, or for any loss arising from your dealings with, or reliance on, any childcare provider found through the Site. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
11. Changes to the Site and Terms
We may update, suspend or discontinue any part of the Site, and may revise these Terms from time to time. The "Last updated" date shows the latest revision. Continued use after changes means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of Malta, and the courts of Malta have exclusive jurisdiction over any dispute arising from them or from your use of the Site.
